These Terms of Service (the “Terms”) govern your use of the websites, landing pages, online forms, text and call services, and related tools (the “Services”) operated by CareBetter Group LLC (“CareBetter,” “we,” “us,” or “our”). By accessing or using the Services, submitting your information, or requesting a quote, you agree to these Terms. If you do not agree, please do not use the Services. Our Privacy Policy explains how we collect, use, and protect your information.
CareBetter is a licensed insurance agency that helps consumers shop for and enroll in health insurance, ACA Marketplace plans, and ancillary insurance products offered by third-party insurance carriers. We are not an insurance carrier and do not underwrite or issue policies. Coverage decisions, policy terms, premiums, and claims are determined by the carrier that issues your policy.
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that the information you provide is accurate and that you are requesting information about insurance for yourself or someone you are authorized to assist.
By submitting your contact information through the Services, you agree that CareBetter, its licensed agents, and its authorized partners may contact you at the phone number and email address you provide — including by automatic telephone dialing systems, prerecorded or artificial voice messages, and SMS/text messages — for purposes of providing quotes, enrollment assistance, and related follow-up. This consent is not a condition of purchasing any product. Message and data rates may apply, and message frequency varies.
Opt-out. You may opt out of text messages at any time by replying STOP, and get help by replying HELP. You may opt out of calls by telling the representative you no longer wish to be contacted, and opt out of marketing emails using the unsubscribe link. Opting out of one channel may not opt you out of others.
Information provided through the Services is for general informational purposes and to facilitate insurance shopping and enrollment. It is not legal, tax, financial, or medical advice. Quotes are estimates and are not a guarantee of coverage, eligibility, or final pricing, all of which are subject to carrier underwriting and approval.
You agree to provide accurate information, to use the Services only for lawful purposes, and not to misuse, disrupt, or attempt to gain unauthorized access to the Services or their systems. You are responsible for maintaining the confidentiality of any account credentials you receive.
The Services, including their content, software, design, and trademarks, are owned by CareBetter or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our written permission.
The Services may contain information about, or links to, third-party carriers and websites. We do not control and are not responsible for third-party products, content, or privacy practices. Your relationship with any carrier is governed by that carrier’s own terms and policies.
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, CareBetter and its owners, officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed one hundred dollars ($100).
You agree to indemnify and hold harmless CareBetter and its owners, officers, members, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts. You and CareBetter agree that any dispute will be brought in an individual capacity and not as part of a class action.
We may update these Terms from time to time. The updated version will be posted with a new Effective Date, and your continued use of the Services after changes take effect means you accept the revised Terms.
